representation to the buyer as a buyer’s agent (if we represent
only the buyer) or as a dual agent (if we also represent the
seller).
Buyer's Information
As a Buyer’s Agent, the firm and its agents must:
• Promote your best interest
• Be loyal to you
• Follow your lawful instructions
• Provide you with all material facts that could influence your
decisions
• Use reasonable skill, care and diligence and
• Account for all monies that we handle for you.
Once you have agreed (either orally or in writing) for our firm and
its agents to be your buyer’s agent, we may not give any
confidential information about you to sellers or their agents
without your permission, so long as we represent you. To make sure
that you and A and W Mountain Rentals & Realty, Inc have a clear
understanding of what our relationship will be and what our firm
will do for you, you may want to have a written agreement. If we do
agree to represent you as a buyer’s agent without a written agency
agreement, before you can make an offer to purchase a particular
property, we must obtain a written buyers agency agreement. |

Who Pays the Buyer's
Agent fee?
Our fee is generally paid from the sellers commission. Even though
the seller pays for our fee, the seller is informed in writing that
we represent the interests of our buying client. If we represent
both the buyer and the seller (as a dual agent, then we would treat
buyers and sellers equally and fairly.
What is the first
thing the buyer should do?
When deciding to buy a home the first thing you need to do is get a
loan. Yes, get the loan before you shop for homes. The lender will
give you a letter stating the maximum amount they will lend you
given your income, debts, and the amount of cash available for down
payment and closing costs.
Seller's Agent or
Subagent of the Seller?
OUR FIRM WILL NOT REPRESENT YOU THE BUYER AS A SUBAGENT OF THE
SELLER, AS WE DO NOT FEEL THIS IS IN THE BUYER’S BEST INTEREST.
Without a buyer’s agent or dual agent, you’re legally on your own.
The seller’s agent or subagent is, in fact, working for the seller
and is the seller’s legal representative. True, a seller’s agent or
subagent can offer buyers some services such as finding a property
to purchase and presentation of your offer. By effect of law, the
seller’s agent or subagent must negotiate on the seller’s behalf and
may not withhold information that could strengthen the seller’s
bargaining position.
• It is rather difficult to understand the concept of Seller’s Agent
or Subagent of the Seller. Most commonly, this is when a firm is the
listing agent for the seller and shows the property to a prospective
buyer. Instead of becoming a dual agent of both the buyer and
seller, they represent only the seller’s interest even though they
have helped the buyer find the property and present the offer.

SELLERS:
As the listing firm, our agents must:

Once you have signed the listing agreement, the firm and its agents
may not give any confidential information about you to prospective
buyers or their agents without your permission, so long as we
represent you. But until you sign the listing agreement, you should
avoid telling the listing agent anything you would not want a buyer
to know.
DUAL AGENT:
Dual agency is when the firm represents both the seller and buyer at
the same time. This “dual agency relationship” is most likely to
happen if the firm is working as a buyer’s agent with someone who
wants to purchase a property that the firm has listed for sale. Both
the buyer and seller must agree in writing to dual agency before
this can occur. A dual agent must treat buyers and sellers fairly
and equally. Although the dual agent owes them the same duties,
buyers and sellers can prohibit dual agents from divulging certain
confidential information about them to the other party.
